PRIVACY POLICY

 

YogaClub is committed to maintaining the accuracy, confidentiality, and security of your personally identifiable information. As part of this commitment, this Privacy Policy governs our actions as they relate to the collection, use and disclosure of Personal Information.

 

INFORMATION COLLECTED

 

YogaClub collects your personal information because it helps us deliver a superior level of customer service.  It enables us to give you convenient access to our products/services and focus on categories of greatest interest to you.  In addition, your personal information helps us keep you posted on the latest product announcements, special offers, and events that you might like to hear about.  In addition, California law requires that we provide you with a summary of your privacy rights under the California Online Privacy Protection Act (“California Act”) and the California Business and Professions Code.  As required by the California Act, this privacy policy identifies the categories of personally identifiable information that we collect through our website about individual consumers and the categories of third-party persons or entities with whom such personally identifiable information may be shared.

 

When you utilize our website and/or subscription service, we may collect personally identifiable information, including your first and last name, your home or other physical address, your phone number, your e-mail address, your style preferences and sizes, purchasing information, and your contact preferences ("Personal Information").   We collect, use and disclose Personal Information to provide you with the product or service you have requested and to offer you additional products and services we believe you might be interested in. In certain circumstances, the purposes for which information is collected may be clear, or consent may be implied, such as where your name, address and payment information is provided as part of the order process.

 

LIMITING COLLECTION

 

The Personal Information collected will be limited to those details necessary for the purposes identified by us. We may collect Personal Information from you in person, over the telephone or by corresponding with you via mail, facsimile, or the Internet.  Protecting children's privacy is especially important to us.  YogaClub and its affiliates do not knowingly collect personal information from children under the age of 13 for marketing purposes, but because some information is collected electronically, it can appear to be the Personal Information of an adult user of the website, and will be treated as such by this privacy policy.  If a child under the age of 13 submits personal information and we learn that personal information is the information of a child under the age of 13, we will delete the user account.  It is our policy to comply with the Children's Online Privacy Protection Act of 1998 and all other applicable laws.  If a child under the age of 13 has provided us with personally identifiable information online, we ask that a parent or guardian contact us.

 

CONSENT

 

Knowledge and consent are required for the collection, use or disclosure of Personal Information except where required or permitted by law. Providing us with your Personal Information is always your choice. However, your decision not to provide certain information may limit our ability to provide you with our products or services. We will not require you to consent to the collection, use, or disclosure of information as a condition to the supply of a product or service, except as required to be able to supply the product or service. 

 

We may occasionally send you newsletters and emails regarding special offers, promotions, features and/or product updates. We may also communicate with you on behalf of third parties about special offers, promotions, features and/or product updates we think may be of interest to you, or you may have opted-in to receive newsletters or special promotions from one of our trusted third party providers. If you decide you do not wish to receive these communications, you may opt-out by clicking the unsubscribe link or by following the instructions included in the communication. Note however that as Monthly Subscriber you cannot opt-out of some administrative communications that are reasonably necessary to the provision of services to you, such as billing or shipment notifications.

YogaClub takes your privacy very seriously and does not sell or rent your contact information to other marketers.  YogaClub takes precautions-including administrative, technical, and physical measures-to safeguard your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction. 

 

Personal Information may only be used or disclosed for the purpose for which it was collected unless you have otherwise consented, or when it is required or permitted by law.  There are certain circumstances in which we may share your personal information with certain third parties without further notice to you, as set forth below:

 

  • We may share information about you with trusted third parties in order to improve your consumer experience. These third parties may contact you about products, services or promotions you may be interested in, or to otherwise improve your customer experience with this website.

 

  • We may share information about you, such as your name and email address, as well as a record of any transactions you conduct on our website or offline with us via our third-party advertising partners and its service providers, in order to deliver to you banner advertisements and other advertising tailored to your interests when you visit certain websites.

We may also disclose such information to law enforcement and/or fraud investigatory agencies, or to other third parties when we, at our sole discretion, reasonably believe it to be necessary to protect our property or other rights or the property or other rights of third parties or the public at large.

YogaClub has safeguards in place to keep your personal information accurate, complete, and up to date for the purposes for which it is used.  You always have the right to access and correct the personal information you have provided and can help us ensure that your contact information and preferences are accurate, complete, and up to date by contacting us at the E-mail address below.  In addition, you can request a copy of your personal information, your purchase history, and your interactions with YogaClub by contacting us at the E-mail address below.  You may verify the accuracy and completeness of your Personal Information, and may request that it be amended, if appropriate.  However, in certain circumstances permitted by law, we will not disclose certain information to you. For example, we may not disclose information relating to you if other individuals are referenced or if there are legal, security or commercial proprietary restrictions.

A cookie is a small computer file or piece of information that may be stored in your computer's hard drive when you visit our websites. We may use cookies to remember and process the items in the shopping cart, improve our website’s functionality and in some cases, to provide visitors with a customized online experience. REQUIRED NOTICE

 

Under California S.B. 27 ("Shine the Light" Law), California residents have the right under certain circumstances to receive, once a year, information about third parties with whom we have shared information about you or your family for their marketing purposes during the previous calendar year, and a description of the categories of personal information shared.  To make such a request, please send an E-mail to the E-mail address below and please include the phrase "California Privacy Request" in the subject line, the subject you are inquiring about, along with your name, address and E-mail address.  We will respond to you within 30 days of receiving such a request.
